Types of Nevada Divorce
There are two types of divorce – Joint Petition and Complaint.
A Joint Petition is when both parties are willing to sign the documents and agree to the terms. This is also called an uncontested divorce.
A Complaint is when one party is not willing to sign or cannot be found.
Joint Petition Divorce
For a Joint Petition Nevada divorce, after you notarize the papers, the documents are filed with the court and are signed by the judge, usually within 3 to 4 days. Then the final paperwork, including the signed divorce decree, is mailed to both parties.
For a Complaint divorce, when you have notarized the papers, we file the initial case with the Court. If your spouse can be served we will coordinate service. If service cannot be completed, then we will coordinate a due diligence search, then publish in the newspaper in the county of your spouse’s last known address once a week for 4 weeks.
If there is no response, the remaining Nevada divorce papers will be filed 21 days after service or the last date of publishing and the Judge will review the case. But if the other party contests, you may need to hire an attorney.
