Types of Annulment
There are two types of annulment – Joint Petition and Complaint.
A Joint Petition is when both parties are willing to sign the documents and agree to the terms.
A Complaint is when one party is not willing to sign or cannot be found.
Joint Petition Annulment
For a Joint Petition annulment, After you have notarized the papers, they are filed with the court and are signed by the judge, usually within 3 to 4 days. Then the final paperwork, including the signed annulment decree, is mailed to both parties.
For a Complaint annulment, when you have notarized the papers, we file the initial case with the Court. If your spouse can be served we will coordinate service. If service cannot be completed, then we will do a due diligence search, then publish in the newspaper in the county of your spouse’s last known address once a week for 4 weeks.
If there is no response, the remaining divorce papers will be filed 21 days after service or the last date of publishing and the Judge will review the case. But if the other party contests, you may need to hire an attorney.
